I-485는 단순한 “미국 안에서 영주권 받는 서류”가 아니라 admissibility, lawful admission/parole, category별 adjustment bar, status violation, unauthorized employment, public charge 적용 여부, criminal/security issue, medical examination 등 다수 쟁점을 동시에 심사합니다.

USCIS fee schedule상 일반 I-485 filing fee는 $1,440이며, 부모와 함께 filing하는 14세 미만 아동은 $950의 reduced fee가 적용되는 경우가 있습니다. 별도의 I-765 및 I-131 수수료 구조도 현재는 과거처럼 I-485 fee에 자동 포함되는 방식이 아니므로 최신 fee schedule 확인이 필요합니다.

I-485 실무

preference category는 filing 시 visa가 available해야 합니다. USCIS가 그 달 어느 filing chart를 허용하는지 확인하고, final approval 시에는 Final Action Date가 current여야 합니다.

대부분의 adjustment applicant는 inspected and admitted 또는 paroled 등 법정 요건을 확인합니다. Immediate relative와 employment-based 등 category별 예외와 bars가 다릅니다.

unlawful status와 unlawful presence는 같은 개념이 아닙니다. unauthorized employment, failure to maintain status, 245(c) bars, employment-based 245(k) 예외 등은 세밀하게 계산해야 합니다.

civil surgeon의 immigration medical examination과 vaccination requirements를 충족해야 합니다. USCIS가 지정한 최신 form edition과 filing rule을 확인합니다.

I-485 pending 중 별도 I-765와 I-131로 work/travel benefits를 신청할 수 있는 경우가 있습니다. 단, Advance Parole 사용과 기존 H/L status 유지 전략은 장기계획에 따라 다릅니다.

USCIS는 interview를 면제할 수도 있지만 사건에 따라 출석을 요구합니다. RFE는 medical, birth certificate, status history, public charge, job portability 등 다양한 이유로 발생할 수 있습니다.

영사절차·NVC 실무

해외에서 immigrant visa를 받는 consular processing은 USCIS petition approval 이후 NVC 단계와 embassy interview 단계로 나뉩니다. 미국 안 I-485와 달리 인터뷰 전까지 immigrant visa가 발급된 것이 아니며, 입국 시점에 LPR status가 시작됩니다.
