12/27/2002 미국에있는 언니로부터 아이둘과 남편이있는 기혼자이 저와 미혼자인 언니와오빠가 함께 형제초청접수에 들어갔습니다. 얼마후 신청완료되었다는 I-797 NOTICE OF ACTION을 미국언니가 받고 기다리다 최근 우선순위일자가 다가오는것 같아 제넘버를 CHEAK STATUS하여보니

On September 15, 2005, the Post Office returned a notice we sent you for your Form I-130, Immigrant Petition for Relative, Fiance(E), or Orphan, Receipt Number WAC**********, because they could not deliver it. This could have a serious effect on your case. Please go to www.uscis.gov/e-request to request a copy of the notice immediately. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

위와같은 문구가 나와 이민국에 문의하여 얼마전에 USCIS로부터 아래와같은 메일을 받았습니다.

Thank you for your inquiry. On January 10, 2015, you or your representative contacted USCIS concerning your Form I-130 to notify us that you have not received your Approval Notice that our electronic systems show was sent to you. Below is a summary of what we found and how the issue has been or may be resolved.

On August 30, 2005, we approved your Form I-130 and sent you an Approval Notice to the most recent address we have on file.

For a duplicate approval notice, you must file a Form I-824, Application for Action on an Approved Application or Petition, with the applicable filing fee and original signature. Please be sure to fill in your receipt number on Form I-824 in Part 3, Additional Information, Question 1.

그리고 저와 같이 초청받은 미혼인 언니와 오빠는 CHECK STATUS 하여보니 두명다

위와같은 문구가 나와서 USCIS에 문의하여 며칠전 아래와같은 이메일 답변을 받았습니다.

The California Service Center (CSC) no longer has jurisdiction over this petition. This case was approved and notification was mailed to the address of record on August 30, 2005. This case has been forwarded to the National Visa Center. Please send any further correspondence to the following address: NVC, 31 Rochester Avenue, Portsmouth, NH 03801-2909. Direct any telephone inquiries to (603) 334-0700. You should receive a duplicate Approval Notice within 14 days.

NOTE: Always include any identifying information about the petition, including full names and dates of birth for petitioner and beneficiary, receipt numbers and the NVC case number SEO**********.

이제 본론으로 들어가서 질문 드리겠습니다.

1.12/27/2002 같은날 접수하여 진행하고 8/30/2005 같은날짜로 승인된것으로 아는데(며칠전 이민국으로부터 받은 이메일 내용중에서) 왜 저만 NVC에 서류가 이관되지 않은것일까요? 주소가 변경된것으로 인해 미국에 얐는 언니가 승인서류를 받지못한건 세명다 같은 상황인데 언니와 오빠는 서류가 NVC로 넘어가고 저만I-824로 다시 재승인 과정을 진행하라는건 무슨뜻인지 제가 가족이 있는 기혼자여서 그런것일까요?

2.현재 형제초청 우선순위 날짜가 4/15/2002로 이고 제서류가 접수된 날이 12/27/2002이니 8개월후면 차례가 되는거 아닌가요? 그런데 I-824 서류접수하면 filling 기간만 1년 가까이 걸린다는데 진행하기전에 먼저 서류접수한 CSC로 전화하여 이와같은 상황을 문의해 보는것이 어떤지 변호사님의 답변을 듣고싶습니다.

3.I-824 접수하려고 작성하는과정에서 Part3 의 1.d.Approval Date란에 며칠전 받은 이메일에 나와있는 내용을 참고하여 08/30/2005라고 쓰면 문제 없을까요?

4.I-824 설명서에 참고용 서류로 가능하면 I-797, N-550, 처음에 접수된 서류등를 함께 보내라는데 초청자는 현재 I-797만 있다고 하네요. 문제없을까요? 시민권 증서는 무엇으로 대체하면 되나요?

5.작년에서야 한국에 거주하는 피초청인인 저와 언니 그리고 오빠의 변경된 한국주소를 USCIS에 우편으로 보냈는데 언니와 오빠의 서류가 NVC로 이관 되었다면 그쪽으로 다시 변경된 주소를 알려야 하나요?
